The terms that apply to bookings and events at our house.
Dear guest, our goal is to make your stay as pleasant as possible. That includes making sure you know which services we provide and what your commitments are. Please read these terms and conditions before entering into the agreement you accept with your booking.
Scope of applicability
- These terms and conditions govern contracts for the rental use of conference rooms, banquet rooms and function rooms in the hotel for holding banquets, seminars, conferences and similar events, as well as all other goods and services rendered by the hotel for the customer.
- The organiser's own general terms and conditions apply only if they have been expressly agreed in writing beforehand.
Conclusion of contract, parties, liability
- For events, the contract comes into force upon the hotel's acceptance (confirmation) of the organiser's application; these are the parties to the contract.
- If the customer or the person placing the order is not the organiser, or if the organiser hires a commercial agent or promoter, that party is liable towards the hotel for all obligations arising from the contract as joint and several debtor together with the customer.
- The organiser has no right to a specific room or apartment. Should the booked room not be available, the hotel is obliged to provide equivalent accommodation in house or at another location.
- The hotel is liable for its obligations set out in the contract. Except in the area typically related to the provision of services, this liability is restricted to defective performance attributable to intent or gross negligence on the part of the hotel. The organiser is obliged to inform the hotel as soon as possible if an extraordinarily high loss is liable to arise.
Cancellation policy
- A free cancellation of the hotel room is possible up to 24 hours before arrival; all later cancellations or no-shows are charged at 100 % of the entire stay.
- Free cancellation for groups of five or more people is possible up to five days before arrival. Later cancellations or no-shows are charged at 100 % of the entire stay.
- HotDeal bookings cannot be cancelled or changed free of charge.
Services, prices, payment
- The hotel is obliged to provide the services ordered by the organiser and confirmed by the hotel.
- The organiser is obliged to pay the agreed prices for these services and settles the invoice without any further written agreement to do so.
- Reserved rooms are available to the customer from 3:00 p.m. If a later arrival has not been agreed specifically, the hotel may cancel the reservation after 6:00 p.m. and re-let the room. Rooms must be vacated no later than 11:00 a.m. on the agreed departure date, unless a later departure has been agreed.
- The agreed prices include value-added tax as required by law. Any change in the rate of VAT is borne by the organiser, regardless of the date of the contract.
- If the period between conclusion and fulfilment of the contract exceeds 180 days, the hotel may raise the contractually agreed price without notice.
- Invoices that do not show a due date are payable in full within ten days of receipt. In case of default, the hotel is entitled to demand interest of 5 percentage points above the base interest rate. The organiser may prove lower, the hotel higher costs.
- The hotel is entitled to demand a reasonable advance payment. The amount and the payment dates may be agreed in writing in the contract.
- Vouchers issued by travel companies are accepted only if an agreement with the company exists or a suitable deposit has been paid. No refund is given for unused services covered by the voucher.
- Claims and rights arising from the agreement with the hotel may only be transferred to third parties with the hotel's explicit permission.
Repudiation by the hotel
- If an agreed advance payment is not made even after a reasonable grace period set by the hotel, the hotel may cancel the contract.
- The hotel may also cancel the contract extraordinarily for materially justifiable cause, for example if force majeure or other circumstances beyond the hotel's control make fulfilment impossible; if the event was booked with misleading or false material facts, such as the identity of the customer or the purpose; if the hotel has justified cause to believe that use of its services might jeopardise smooth operation, security or public reputation without this being attributable to the hotel; or if the accommodation, areas or rooms are sub-let without the hotel's prior written consent.
- The hotel must inform the organiser immediately that it is exercising its right to cancel.
- Withdrawal from the contract does not justify claims for compensation by the organiser, except in cases of intent or gross negligence on the part of the hotel.
Repudiation by the organiser
- The organiser may cancel the contract free of charge up to six weeks before the start of the event. With later cancellations, the hotel may charge 80 % of the originally agreed price for its services, insofar as it is not possible to let the rooms to other parties.
- Saved expenses are taken into account. The organiser may prove that the claim did not arise or did not arise in the amount demanded; the hotel may prove that a higher claim has arisen.
Provisional bookings
Provisional bookings are binding for both parties. After the end of the option period, the hotel may let the reserved accommodation and rooms to other parties.
Changes in the number of participants and event times
- A change in the number of participants of more than 5 % must be communicated to the hotel no later than five working days before the event; the hotel must give its consent.
- A reduction of the number of participants of up to 5 % is taken into account in the final invoice. If the reduction is larger, the original number of participants less 5 % is charged.
- If the number of participants increases, the actual number is charged.
- If the number of participants changes by more than 10 %, the hotel may recalculate the agreed prices and exchange the confirmed room reservations, unless this is unreasonable for the organiser.
- If the agreed starting or ending times of the event change and the hotel agrees to the deviation, the hotel may reasonably charge for the additional stand-by service, unless the hotel is at fault.
Bringing food and beverages
The organiser may not bring food or beverages to events. Exceptions must be agreed in writing with the hotel; in such cases a charge is made to cover overhead expenses.
Technical facilities and connections
- If the hotel obtains technical or other equipment from third parties for the organiser at the organiser's request, it does so in the name of, with power of attorney from and for the account of the customer. The organiser is liable for careful handling and proper return of the equipment and indemnifies the hotel against all third-party claims arising from its provision.
- Explicit consent is required for connecting the organiser's electrical systems to the hotel's electrical circuit. The organiser is liable for malfunctions of or damage to the hotel's technical facilities caused by such equipment, unless the hotel is at fault. The hotel may charge a flat fee for the electricity used.
- The customer may use his own telephone, fax and data transfer equipment with the hotel's consent.
- The hotel may charge a connection fee and/or compensation for lost revenue if its own suitable equipment remains unused.
- Malfunctions of technical or other equipment provided by the hotel are remedied promptly whenever possible. Where the hotel is not responsible for such malfunctions, payment may not be withheld or reduced.
Loss of or damage to property brought in
- The organiser bears the risk of damage to or loss of exhibits or other items, including personal property, brought into the function rooms or the hotel. The hotel assumes no liability for loss, destruction or damage, including financial loss, except in cases of gross negligence or intent on the part of the hotel.
- Decoration and decorative material brought in by the organiser must comply with fire protection requirements; the hotel may demand official evidence. Because of the risk of damage, the hotel must be consulted before objects are assembled or installed.
- Exhibits and other items brought in must be removed immediately after the end of the event. If the customer fails to do so, the hotel may remove and store them at the organiser's expense. If the items remain in the room used, the hotel may charge reasonable compensation for use for the duration. The organiser may prove that lower costs were incurred; the hotel may prove a higher claim.
Organiser's liability for damage
- The organiser is liable for all damage to buildings or furnishings caused by participants, visitors, employees, other third parties associated with the organiser or the organiser himself.
- The hotel may require the customer to provide reasonable security, for example insurance, a security deposit or a surety.
Final provisions
- Amendments or supplements to the contract, the acceptance of the application or these terms and conditions should be made in writing. Unilateral amendments or supplements by the organiser are invalid.
- The place of performance and payment is the location of the hotel.
- For commercial transactions, the courts at the location of the hotel have jurisdiction. The same applies if a party meets the requirements of section 38 (1) of the German Code of Civil Procedure (ZPO) and has no legal domicile in Germany.
- The contract is governed by and construed in accordance with the laws of the Federal Republic of Germany.
- Should individual provisions of these terms and conditions be or become invalid or void, the validity of the remaining provisions remains unaffected.
